Welcome to CustomPatched.com. By placing an order with us, you agree to the following terms and conditions. Please read them carefully, as they outline the important legal and practical aspects of our service relationship, from design ownership to shipping responsibilities.

1. The Design & Revision Process

Our process is collaborative and built for clarity. To ensure your custom patches meet expectations:

• Your Detailed Brief is Crucial: The accuracy and detail of the initial design brief you provide directly impact the final product. Please include all desired specifications: exact colors (PMS numbers if available), dimensions, thread type preferences, artwork files, and any specific notes.

• Unlimited Revisions on the Digital Proof: We offer unlimited, free revisions on the initial digital draft we create based on your brief. This is your opportunity to fine-tune every detail.

• Final Approval is Binding: Once you explicitly approve the final digital proof via email or our project portal, production begins. No further design changes, alterations, or cancellations can be accepted at this stage, as materials are immediately sourced and machines are programmed. Any changes requested after final approval will constitute a new order.

2. Ownership & Intellectual Property Rights

We respect and protect creative ownership.

• Your Provided Assets: You retain full ownership of any logos, artwork, or designs you submit to us for production. CustomPatched.com claims no ownership over client-provided intellectual property. We use these assets solely for the purpose of fulfilling your order.

• Our Original Designs: If our design team creates original artwork for you based on a concept (a “work made for hire”), upon full payment, all rights and ownership of that final designed artwork are transferred to you, the client.

• Your IP Responsibility – A Critical Clause: You represent and warrant that any design, logo, or artwork you provide does not infringe upon any third party’s copyright, trademark, or intellectual property rights. You are solely responsible for securing any necessary permissions or licenses. If a design is found to infringe upon another’s IP, CustomPatched.com reserves the right to halt production immediately and will not be held liable for any resulting claims, damages, or legal actions taken against you.

3. Shipping, Delivery & International Orders

• Processing & Production Times: All timelines provided are estimates. Production begins only after final proof approval. While we strive for efficiency, unexpected delays in material sourcing or production can occur.

• Shipping & Transit: We are not liable for delays once a package is handed to the shipping carrier (USPS, UPS, FedEx, DHL, etc.). Tracking information will be provided upon shipment.

• International Customers – Important Note: For orders shipped outside of our primary warehouse country, the customer is solely responsible for all import duties, taxes (VAT, GST, etc.), and customs clearance fees. These are not included in your order total and are determined by your local government. Please check your country’s regulations before ordering to avoid surprises.

4. Returns, Refunds & Liability

• Our separate, detailed Return & Exchange Policy governs these areas. Please review it prior to ordering.

• Our total liability, in any circumstance, shall not exceed the total value of the order in question. CustomPatched.com is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products.

5. Order Acceptance & Agreement

• Placing an order on CustomPatched.com constitutes an offer to purchase under these Terms.

• We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, IP infringement, or inability to fulfill the request.

• By completing your purchase, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Return Policy.
